The Australian Competition and Consumer Commission (ACCC) said today that Apple, by advertising the new iPad as 4G-capable, is in violation of Australian consumer law.
The ACCC intends to apply to the Federal Court in Melbourne to get fines imposed on Apple and an injunction against sales of the device. The group alleges that Apple’s advertising campaign is misleading, saying in a statement that “…Apple’s recent promotion of the new “iPad with WiFi + 4G” is misleading because it represents to Australian consumers that the product “iPad with WiFi + 4G” can, with a SIM card, connect to a 4G mobile data network in Australia, when this is not the case.”
Apple’s Australian website only states that the WiFi + 4G iPad can connect to 4G networks in the States and Canada. Australia does have access to a 4G network but it uses a different frequency band to the one required by the iPad.
